利用規約

この利用規約（以下「本規約」）は、WalkFrame（以下「運営者」）が提供する録音アプリ「HearSeal」（以下「本アプリ」）と、そのウェブサイト・検証ページ（以下「本サイト」）の利用条件を定めます。本アプリを使った時点で、本規約に同意したものとみなします。

第1条（本アプリの内容）

本アプリは、録音を封印し、外部のサービスに署名してもらうことで、録音が後から編集されていないことを確かめられるようにする録音アプリです。録音の保存、文字起こし、検索、AI サマリなどの機能を含みます。情報の取り扱いはプライバシーポリシー に定めます。

第2条（証明の範囲と保証しないこと）

  1. 本アプリと本サイトが示すのは、録音とその記録が端末で作られてから変更されていないこと、および外部のサービスが保証した時間の範囲に録音されたことに限られます。マイクに入った音が本物の会話であること、端末の時計や位置情報の正しさは証明しません。
  2. 運営者は、録音や検証結果が、裁判・捜査・交渉その他の手続きで証拠として採用されること、または特定の効力を持つことを保証しません。証拠としての扱いは、それぞれの手続きの判断によります。
  3. 文字起こしと AI サマリは自動で作る参考資料であり、正確さを保証しません。証拠は音声そのものです。
  4. 端末の不具合、OS の制約（通話中は録音できないことなど）、省電力機能、通信の状態、保存先や外部サービスの停止などにより、録音・保存・署名ができない場合があります。

第3条（利用者の責任）

  1. 録音してよいかどうかは、国や地域の法令によって異なります。利用者は、自らの責任で、適用される法令を守って本アプリを使うものとします。運営者は法的な助言を行いません。
  2. 録音・文字起こし・サマリの取り扱い（保存、第三者への提出など）は、利用者の責任で行うものとします。
  3. 端末と保存先のアカウントの管理は、利用者が行うものとします。

第4条（禁止事項）

利用者は、次の行為をしてはなりません。

  1. 相手に無断で性的な行為を記録すること、またはその録音を拡散すること
  2. 他人の私生活をひそかに監視・盗聴する目的で使うこと
  3. 法令または公序良俗に反する行為、他人の権利を侵害する行為
  4. 本アプリ・本サイト・運営者の時刻証明サーバ・AI サマリの機能に過度な負荷をかける行為、不正に利用する行為（改造したアプリからの利用、利用回数の制限を回避することなど）
  5. 本アプリを複製・改変・逆コンパイルする行為（公開しているソースのライセンスで認められる範囲を除く）
  6. 録音や検証結果を偽り、本アプリが証明していないことを証明されたかのように示す行為

第5条（有料機能と広告）

  1. 一部の機能は有料です。価格・内容は、ストアの表示とアプリの中の表示によります。
  2. 購入・解約・返金は、Google Play の規約と手続きに従います。
  3. 無料版では広告を表示することがあります（パーソナライズしない広告に限ります）。

第6条（AI サマリ）

AI サマリを使うと、その日（または選んだ時間帯）の録音の文字起こしとメモが AI（Cloudflare の Workers AI）に送られます。利用者は、送る内容を確認し、同意したうえで使うものとします。利用回数に上限を設けることがあります。

第7条（ソースの公開）

検証の方法（仕様）と検証ツールは、それぞれに付したライセンス（GNU AGPL v3）で公開しています。それ以外の本アプリの部分の権利は運営者に帰属します。

第8条（変更・停止・終了）

  1. 運営者は、本アプリ・本サイトの内容を変更し、または提供を停止・終了することがあります。終了するときは、相当の期間をおいてお知らせします。
  2. 提供を終了した後も、すでに保存した録音は、公開している検証ツールで確かめられます。

第9条（免責）

  1. 運営者は、本アプリの利用、または利用できなかったことにより利用者に生じた損害について、運営者の故意または重大な過失による場合を除き、責任を負いません。
  2. 運営者が責任を負う場合でも、その範囲は、損害が生じた月に利用者が運営者に支払った金額を上限とします。ただし、消費者契約法その他の法令によりこの制限が認められない場合は、この限りではありません。
  3. Google・Dropbox・外部の時刻証明サービスなど、第三者のサービスの不具合・変更・停止について、運営者は責任を負いません。

第10条（規約の変更）

運営者は、必要に応じて本規約を変更できます。変更するときは、変更の内容と効力が生じる日を、本サイトとアプリの中で事前にお知らせします。

第11条（準拠法・管轄）

本規約は日本法に準拠します。

Terms of Use

These Terms govern your use of the HearSeal recording app (the “App”) and its website and verification page (the “Site”) provided by WalkFrame (“we”). By using the App you agree to these Terms. If the Japanese and English versions differ, the Japanese version prevails.

1. The App

The App seals recordings and has external services sign them, so that anyone can check that a recording has not been edited later. It includes recording, storage, transcription, search and AI summaries. See the Privacy Policy for how information is handled.

2. What is proven, and no warranty

  1. The App and Site show only that a recording and its records have not changed since they were made on the device, and that it was recorded within the time range vouched for by external services. They do not prove that the sound was a real conversation, or that the device’s clock or location was correct.
  2. We do not guarantee that recordings or verification results will be accepted as evidence, or have any particular effect, in court, investigations, negotiations or any other proceeding. That is for each proceeding to decide.
  3. Transcripts and AI summaries are automatically generated reference material and may be inaccurate. The evidence is the audio itself.
  4. Recording, saving or signing may fail because of device issues, OS restrictions (for example, recording is not possible during calls), battery optimization, network conditions, or outages of storage or external services.

3. Your responsibilities

  1. Whether you may record depends on the laws where you are. You are responsible for using the App in compliance with applicable laws. We do not give legal advice.
  2. You are responsible for how you handle recordings, transcripts and summaries, including storing them and giving them to others.
  3. You are responsible for managing your device and storage accounts.

4. Prohibited use

  1. Recording sexual acts without the other person’s consent, or spreading such recordings
  2. Secretly monitoring or eavesdropping on another person’s private life
  3. Anything illegal or that infringes others’ rights
  4. Overloading or abusing the App, the Site, our time-proof server or the AI summary feature (including using modified apps or circumventing usage limits)
  5. Copying, modifying or decompiling the App, except as permitted by the licenses of our published source code
  6. Misrepresenting recordings or verification results as proving something the App does not prove

5. Paid features and ads

  1. Some features are paid. Prices and contents are as shown in the store and in the App.
  2. Purchases, cancellations and refunds follow Google Play’s terms and procedures.
  3. The free version may show ads (non-personalized only).

6. AI summaries

Using AI summaries sends the transcripts and notes of the day (or the time range you choose) to AI (Cloudflare Workers AI). You use this feature after reviewing what is sent and agreeing to it. Usage may be limited.

7. Published source

The verification method (specification) and verifiers are published under their own license (GNU AGPL v3). All other parts of the App are the property of WalkFrame.

8. Changes, suspension and termination

  1. We may change, suspend or end the App or the Site. We will give reasonable notice before ending it.
  2. After it ends, recordings you have already saved can still be checked with the published verifiers.

9. Limitation of liability

  1. Except in cases of our intent or gross negligence, we are not liable for damages arising from your use of, or inability to use, the App.
  2. Where we are liable, our liability is limited to the amount you paid us in the month the damage occurred, unless such a limit is not permitted by the Consumer Contract Act or other applicable law.
  3. We are not responsible for failures, changes or outages of third-party services such as Google, Dropbox or external time-proof services.

10. Changes to these Terms

We may change these Terms when necessary. We will announce the changes and their effective date in advance on the Site and in the App.

11. Governing law and jurisdiction

These Terms are governed by the laws of Japan.
